https://5gmaxnet.com ("5gmaxnet Broadband Service") is an Internet based portal owned and operated by 5gmaxnet Broadband Services, a company incorporated under the laws of India, with its office Janapriya Kapra, ECIL, Hyderabad, 500062 .

Use of the Website is offered to you conditioned on acceptance of all the terms, conditions and notices contained in these Terms, along with any amendments made by 5GMAXNET BROADBAND SERVICES at its sole discretion and posted on the Website, including by way of imposing an additional charge for access to or use of a Service.

Your use of the Website and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If you transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction.

By mere use of the Website, You shall be contracting with 5GMAXNET BROADBAND SERVICES and these terms and conditions including the policies constitute your binding obligations, with 5GMAXNET BROADBAND SERVICES. For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Website by providing Registration Data while registering on the Website as Registered User using the computer systems.

5GMAXNET BROADBAND SERVICES allows the User to surf the Website or making purchases without registering on the Website. The term "We", "Us", "Our" shall mean 5GMAXNET BROADBAND SERVICES. When You use any of the services provided by Us through the Website, including but not limited to, (e.g. Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use.

We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to you. It is your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of the Website following the posting of changes will mean that you accept and agree to the revisions.

As long as you comply with these Terms of Use, We grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.

Teams & Conditions for 5GMAXNET Regular Highspeed & Entertainment Combo Plan Unlimited Internet Access/Data Benefit:

1. The 5GMAXNET 5GMAXNET Regular Highspeed & Entertainment Combo Plan Unlimited Data Benefit is being provided to 5GMAXNET Fibernet customers in India on selected plans.

2. This benefit cannot be combined with any other offer provided by 5GMAXNET

3. The Unlimited Benefit is intended only for Personal and Non-Commercial Use, and not for any commercial, special or enterprise purposes. Consequently, in accordance with the current Fair Usage Policy and in view of the regulatory compliances and also, to provide optimum service to the consumers and protect their interests, the speed of data post consumption of 3300 GB within a billing cycle shall be reduced to 1Mbps.

4. MAX WEB TV (5GMAXNET) reserves the right to end/ suspend/modify the benefit at all times, as well as in specific cases of commercial use, or any fraudulent use.

5. These Terms and Conditions shall constitute an agreement between MAX WEB TV (5GMAXNET) and each customer and by subscribing to the benefit, customer accepts the same as binding upon him/her.

6. MAX WEB TV (5GMAXNET) will be entitled to postpone, suspend, modify or cancel the benefit or any aspect thereof, across the entire territories of service or any part thereof, at any time with or without notice, for any reason, including, but not limited to, acts of God, force majeure, technical difficulties, or any other reasons beyond MAX WEB TV (5GMAXNET)'s reasonable control. If MAX WEB TV (5GMAXNET) suspends or cancels the Offer, all aspects of the Offer shall be null and void. MAX WEB TV (5GMAXNET) will not be liable to compensate any customer for any postponement or cancellation or for any reason directly or indirectly arising out of this Offer.

7. MAX WEB TV (5GMAXNET) has no liability whatsoever in respect of any claims or disputes and any resulting damages or losses, whether direct or indirect, relating to the customer availing, not receiving or customer's use of the benefit.

8. MAX WEB TV (5GMAXNET) makes no warranties or representations whatsoever in respect of the benefit and the broadband services including as to its fitness for any particular purpose, merchantability, quality, availability, disruption or error free operation.

9. Any dispute or claim (contractual or non-contractual) arising out of or in relation to this agreement, including disputes as to its formation, will be governed by and construed in accordance with Indian laws. Subject to the point above, MAX WEB TV (5GMAXNET) and the customer submit to the exclusive jurisdiction of Courts at Coimbatore alone.

Terms & Conditions Regular Highspeed & Entertainment Combo Plans:

1. All Prices Mentioned on this website are exclusive of taxes.

2. Speed Indicated is till our ISP node only. Maximum possible speeds are as per mentioned in plans will be configured.

3. Maximum feasible speeds is subject to our network capability in your area and also depends on network traffic.

4. All equipment supplied by us shall remain our property at all times.

5. Customer is liable to pay monthly rental & any Penalty till CPE (Customer Premises Equipment) is returned in good condition.

6. Registration, Installation/Configuration charges applicable.

7. Additional FUP TopUp Packs are valid only for the current billing cycle and will not be carry forwarded. (NO DATA CARRY FORWARD)

8. Unutilized free benefits will be forfeited at the end of validity.

9. MAX WEB TV (5GMAXNET) reserves full rights to alter or make changes to plans without any prior notification.

10. Regular Highspeed & Entertainment Combo Plans and Offers are Available on Selected areas and Offers may vary depending on Urban and Rural Geographical Locations. Please contact Local Area 5GMAXNET Representative for more information's on Plans.

Terms & Conditions for 5GMAXNET XFIBER Plans:

1. All Prices Mentioned on this website are exclusive of taxes.

2. Any benefit with Plans cannot be combined with any other offer provided by 5GMAXNET

3. This Plan is intended only for Personal and Non-Commercial Use, and not for any commercial, special or enterprise purposes.

4. MAX WEB TV (5GMAXNET) reserves the right to end/ suspend/modify the benefit at all times, as well as in specific cases of commercial use, or any fraudulent use.

5. These Terms and Conditions shall constitute an agreement between MAX WEB TV (5GMAXNET) and each customer and by subscribing to the benefit, customer accepts the same as binding upon him/her.

Terms & Conditions Static IP Address:

No Free Static Or Public IP Address will be provided to any customers. Customers are provided access via PPPOE Concentrator using secured Username and Password to each and every customer.

Customers can subscribe for Static/Public IP with additional charge of 2500/- per IP per annum. Taxes Extra as Applicable.

Note: Customer can request only one static/Public IP per Username. Additional IP Provisioning is not possible.

Terms & Conditions for New Subscribers:

1. Installation Charges of 1000.00/- (Taxes Extra will be applicable).

Note: Installation Charges may vary depending on the Location, Area and Port Availability.

2. Device Charges of 2500.00/- for Equipment Supplied by 5GMAXNET.

3. All Customers must Submit the signed copy CAF along with Valid Govt. Issued ID and Address Proof (Mandatory).

4. 200meters of OFC cable from our Nearest Node will be provided free of cost. Any additional cable required will be charged extra @ rate of 10/- per meter from the customer.

5. First Time installation and Provision of Fiber and Splicing is free of cost. But if customer wants to relocate fiber to any other location within the home additional charge of 300/- will be charged per instance.

6. In case of Prepaid Plans Customer needs to pay advance one month plan charges+GST along with the CAF and Proof Documents.

7. If any Damage happens to CPE Devices or its Power Adapters due to Power Issues/Lightening at Customer Site No Exchange or Replacement will be Provided. Customer must Ensure the safety of CPE Devices provided to them. Incase of Fiber Cable / Connector Damage at within Customer Premises is Found additional Splicing charge of 500/- will be charged per instance.

8. No Refund will be provided if the customer wishes to cancel the connection post provisioning of Fiber at Customer Premises.

Terms & Conditions for Refundable Security Deposit:

Security Deposit Collected at the time of Installation is Refundable only at certain conditions mentioned below:

1. Case 01: Terminating Link within 12 Months from the Date of Activation: Customer can claim 100% security deposit during the time of termination of the connection by surrendering the CPE Devices/Routers along with Original Box/Packing and Termination Box to 5GMAXNET Office in Working Condition.

2. Case 02: Terminating Link Above 12Months and Less than 24Months from the Date of Activation: Customer can claim 50% security deposit during the time of termination of the connection by surrendering the CPE Devices/Routers along with Original Box/Packing and Termination Box to 5GMAXNET Office in Working Condition.

3. Case 03: Terminating Link Above 24Months from the Date of Activation: If Device is used more than 24months or Termination Request is received post 24months after activation. No Refund will be Provided. Surrendering of CPE Device is not required in this case.

4. At the time of Surrendering the Equipment Customer must ensure that the CPE Devices/Routers along with Original Box/Packing and Termination Box is in Working Condition and is free from any visible damages.

5. In case if there is any type of Physical Damage or CPE Device is not in working condition or Original Box is Missing no Refund will be Provided.

6. Once Surrender Request is accepted, Security deposit will be refunded to customer within 7-15 Working Days via Cheque only. Once the Cheque is ready our Executive will call and inform the customer.

7. If the customer surrenders the connection within a period of 3 months of active paid usage, early surrender charges of 1000.00/- will be deducted along with any unpaid bills from the refundable deposit.

8. If the CPE must be returned in Working Condition and should be free from any Damages/ Visible Scratches or INK or Pen Marks or other Dirts else no refund will be provided. and customer can keep the CPE with them. Also If Adapter or Power Cable is Damaged or found not working at the time of return then 500.00/- will be deducted from the refundable deposit.

9. In case if the account remains de-active/expired for more then 90Days due to non payment of Bill/No Recharge for Continuous 90Days then the Security Deposit amount Paid at the time of installation will be forfeited and the account will be deleted. Refer Terms & Conditions for Account Deactivation & Reactivation for more details.

Terms & Conditions for OTT:

OTT service is available in selected areas & selected plans only.

· Free OTT Subscription is provided only to the Entertainment Combo Plan plans.

· OTT Subscription provided for other plans is on add-on basis.

· OTT Apps provided by us may not support all Android Devices or Smart TV

· Users can also install the OTT/OTT Play App on any Compatible Android/Apple Devices.

· OTT Subscriptions Provided by us is a Free/Temporary Service/Benefit and can be removed or stopped any time without any prior notice.

· The benefits under this offer are non-transferable. No exchange or redemption for an equivalent cash amount or in any other form shall be allowed.

· Any issues related to claims, issues, damages or losses with regards to the quality or functionality of the movies/shows access should be escalated to respective OTT Providers. 5GMAXNET (MAX WEB TV) will not be responsible for the OTT content access and content availability.

· 5GMAXNET will have no liability against any claims arising out of or in connection with the use of the OTT content or for any loss or damage of whatsoever nature caused to Eligible Subscriber or any third party in connection with the subsistence of the OTT contents

· Please ensure that the mobile number provided during registration does not already have any of the OTT services active, else it will be rejected at provisioning stage.

· OTT Services mentioned herewith (Zee5, Sunnxt, SonyLiv, Shemaroo Me,Disney+ Hotstar, Netflix, Gaana, Eros Now, EpicON...etc) are provided by PlayboxTV/OTTPlay, the authorized reseller for these services.

· 5GMAXNET (MAX WEB TV) reserves the right, at its sole discretion, to modify these Terms & Conditions or any part thereof at any time without prior notice, if so required in view of business exigencies and/or guidelines issued / amended by TRAI, Department of Telecom (DOT) and/or such other statutory agency that changes applicable to 5GMAXNET (MAX WEB TV), and the same shall be binding on the subscribers who have recharged under this offer.

· Any changes in the Terms will be posted on https://5gmaxnet.com (“Website”) & customer is advised to check this Website regularly for any update(s) or amendment(s) made to these Terms and Conditions.

· 5GMAXNET (MAX WEB TV) reserves the right to extend, cancel, discontinue, suspend or prematurely withdraw the offer at any time during its validity as may be required in view of business exigencies and/or changes by TRAI, Department of Telecom (DOT) and/or such other applicable statutory changes without any notice & customer is advised to check this Website regularly for any update(s) or amendment(s) made to these Terms and Conditions.

· In addition to the limitations mentioned in this document, in no event will 5GMAXNET (MAX WEB TV Private Limited) or our directors, managers, officers, employees, agents or other representatives be liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to this offer. Total liability, whether in contract, warranty, tort (including negligence) or otherwise, shall not exceed the last fee paid by the customer.

· Any dispute or claim (contractual or non-contractual) arising out of or in relation to this agreement, including disputes as to its formation, will be governed by and construed in accordance with Indian laws. Subject to the point above, 5GMAXNET (MAX WEB TV) and the customer submit to the exclusive jurisdiction of Courts at Coimbatore, Tamil Nadu alone.

· All Standard Terms and Conditions of Respective OTT Platforms is applicable

Terms & Conditions for IPTV:

IPTV service is available in selected areas & selected plans only.

· Free IPTV Subscription is provided only to the Selected plans.

· Free IPTV App (ULKA) provided by us may not support all Android Devices or Smart TV

· Users can install the IPTV App on any Compatible Android/Apple Devices.

· IPTV Subscriptions Provided by us is a Free/Temporary Service/Benefit and can be removed or stopped any time without any prior notice.

· The benefits under this offer are non-transferable. No exchange or redemption for an equivalent cash amount or in any other form shall be allowed.

· Any issues related to claims, issues, damages or losses with regards to the quality or functionality of the movies/shows access should be escalated to respective IPTV Provider (ULKA TV). 5GMAXNET (MAX WEB TV) will not be responsible for the IPTV content access and content availability.

· 5GMAXNET will have no liability against any claims arising out of or in connection with the use of the IPTV content or for any loss or damage of whatsoever nature caused to Eligible Subscriber or any third party in connection with the subsistence of the IPTV contents

· Please ensure that the mobile number provided during registration does not already have any of the IPTV services active, else it will be rejected at provisioning stage.

· IPTV Services mentioned herewith includes Paid/FTA TV Channels and are provided by ULKA TV, the authorized for these services.

· All Standard Terms and Conditions of Respective IPTV Platform is applicable.

Terms & Conditions for Account Deactivation & Reactivation:

1. In case of non payment of bill for more then 30days, Account will be automatically deactivated by the system.

2. Customer can Reactivate the Account within next 30days by clearing all outstanding dues. No Reactivation Charges will be charged within 30days from date of deactivation.

3. In case if the customer dose not clear the outstanding within the 30days from the date of deactivation then customer must pay Reactivation charges of 500.00/- along with the outstanding dues.

4. In case if the account remains expired (without Recharging) for more then 90Days then the Security Deposit amount Paid at the time of installation will be forfeited and the account will be deleted.

Terms & Conditions for Bill Payment:

It would be the responsibility of subscribers to make monthly/quarterly/annually payment of internet services. MAX WEB TV (5GMAXNET) and its Franchise would disconnect the service in case of non receipt of bill payment without giving any prior notice to the subscriber.

Any loss of business suffered by the customer due to disconnection affected will be his/her own responsibility and so borne by him/her. Temporary Break or disconnection of service under scheduled maintenance will not require any notice.

Online Refund Policy:

All sales of service are final and there will be no refund or exchange permitted. Please be advised that You are responsible for the Recharge for and all charges that result from those purchases. (5GMAXNET Broadband Services) is not responsible for any purchase of Recharge for an incorrect account number.

However, in a case where a transaction has been completed by you on the Site, and money has been charged to your card or bank account but a Services has not delivered within 24 hours of your completion of the transaction then you may inform us by sending us an email on (ktreddy.maxnet@gmail.com) or posting us a message. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - Recharge value, Transaction date and Order Number ( ) shall investigate the incident and if it is found that money was indeed charged to your card or bank account without delivery of service then you will be refunded the money within 7 working days from the date of the receipt of your email

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

Force Majeure & Illegal Use:

If at any time, during the continuance of our internet services, the performance in whole or part, of any obligation under it shall be prevented or delayed by reason of WAR, Hostility, Acts of the public enemy, Civil commotion, Sabotage, Fire, Flood, Explosion, Epidemic, Quarantine Restriction, Strikes, Lock-out or ACT OF GOD...etc. The subscriber shall not claim for any damages against MAX WEB TV (5GMAXNET) and its franchise in respect of such non performance or delay in performance of our internet services.

Internet Service may be used only for lawful purposes. Transmission, distribution or storage of any materials in violation of any applicable law or regulation is prohibited. This includes, withour limitation, material protected by copyright, trademark, trade secrete or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illigal threat, and Violates Export control laws or anti-national

Sending unsolicited messaging via internet services is unlawful and it is not permitted.

Probing for means of gaining unauthorized access to computers or networks is not permitted. Sending harassing or threatening transmission over the Internet Service is not permitted

Internet contains uneditted materials some of which may be sexually explicit or offensive & provocative for which we have no control. Any Objectionable or obsceane message or communications, which are inconsistant with the established laws of the country are not created, stored, downloaded, accessed, transmitted or retransmitted by any person using our facilities.
